Copyright Infringement Notification (DMCA Takedown Request)

Your DMCA notice must include the following information, as required by Section 512(c)(3) of the DMCA:

  6. A statement that the information in the notification is accurate and, under penalty of perjury, that you are the copyright owner or authorized to act on behalf of the owner

Incomplete or misleading notices may be ignored.

What Happens After We Receive a DMCA Notice?

Upon receipt of a valid DMCA notice:

  • The allegedly infringing content will be temporarily removed or access to it will be disabled

  • We may notify the user who posted the content and provide them with a copy of the notice

  • That user has the right to issue a counter-notification if they believe the takedown was a mistake or misidentification

Counter-Notification

If you are a user and believe that content you posted was removed in error, you may send us a counter-notification. Your counter-notice must include:

  1. Your physical or electronic signature

  2. Identification of the material that has been removed and the location where it appeared before it was removed

  3. A statement under penalty of perjury that you have a good faith belief the content was removed due to a mistake or misidentification

  4. Your name, address, phone number, and email address

  5. A statement that you consent to the jurisdiction of the federal court in your district, and that you will accept service of process from the original complainant

We may restore the removed content within 10 to 14 business days unless the original complainant files a court action to prevent restoration.

Repeat Infringers

In accordance with the DMCA and other applicable laws, UnitedState has a policy of terminating, in appropriate circumstances, users or contributors who are repeat infringers of intellectual property rights.
